Background

The Gujarat Public Service Commission issued an advertisement dated 23.09.2015 for direct recruitment to various Professor posts, including Professor (Plastic Engineering), under the Government Engineering Colleges Recruitment Rules, 2012. Selection was prescribed solely through interview. The respondent-candidate participated, secured 28/100 marks against the prescribed minimum of 45, and was not selected. After being unsuccessful, she challenged the process by invoking the AICTE (Career Advancement Scheme) Regulations, 2012.

 

Issues Framed

Whether the AICTE All India Council for Technical Education (Career Advancement Scheme) Regulations, 2012apply to direct recruitment of Professors conducted by the State Commission under State Recruitment Rules.

 

Court’s Reasoning

• The Court analysed ss. 10 and 23 AICTE Act, 1987, and the structure of the 2012 AICTE Regulations.
• It held that the Regulations are not recruitment rules, but promotion and career progression norms applicable only to incumbent or newly appointed teachers within the academic system under the Career Advancement Scheme (CAS).
• The use of “direct recruitment” in the Regulations is limited to entry stages within CAS, presupposing an existing service profile; they cannot apply to open-market recruitment.
• State Recruitment Rules and AICTE CAS Regulations operate in distinct fields; hence, no question of override arises.
• The High Court erred in invalidating the selection by extending CAS Regulations beyond their purpose.
• Additionally, a candidate who participates without protestcannot challenge the selection criteria after being unsuccessful, applying settled law (Anupal Singh v. State of U.P., (2020) 2 SCC 173).
 

Decision 

The appeal was allowed. The High Court’s judgment dated 20.08.2025 was set aside, and the 2015 recruitment process was upheld. No costs were awarded.

 

Ratio

AICTE Career Advancement Scheme Regulations, 2012 do not apply to direct recruitment of Professors conducted under State recruitment rules, and a candidate who participates in such selection without protest is estopped from challenging the process after being declared unsuccessful.
